Naveen Andrews has just left family court with his son, and the baby mama is sitting on the courthouse steps bawling.

The "Lost" star and Elena Eustache, the mother of three-year-old Naveen Joshua, were in L.A. County Superior Court, where a judge changed the custody order after Elena allegedly took the boy out of L.A. County without permission. Naveen also claimed Elena kept the boy from him.
The parents had joint custody, but today, with the help of disso-queen Laura Wasser, the order was modified so Naveen now has sole physical and legal custody pending a full hearing next month.
We're told Elena has alleged Naveen's girlfriend, Barbara Hershey, practices witchcraft and that Naveen and Hershey have poisoned the boy. In response, Wasser asked the judge to order Elena to undergo psychiatric testing.
Elena brought the boy to court. After the ruling, the bailiff took the boy from Elena and gave him to Naveen, who left the courthouse with Hershey.
Under the new order, the boy is allowed to travel to Hawaii where Naveen films "Lost". He can be accompanied either by Naveen or Hershey.
After the hearing, Elena told TMZ, "I can't believe celebrities and their money. They always get what they want."

Dr. Jan Adams, the non-board certified plastic surgeon who operated on Kanye West's mother the day before she died, has been sentenced to one year in jail after rolling over to a charge he drove super drunk last year.
Adams pleaded no contest to one misdemeanor count of DUI over an incident in the Bay Area last June where he was caught driving the wrong way on a freeway with a blood alcohol level of .20 -- more than twice the legal limit.
Adams will receive eight days credit toward his sentence from the time he served right after he was arrested.

Joe Francis and Larry Flynt claim the economy has made America's sexual appetite go limp, so they're going to the one place where sex is always rampant -- Congress.
Flynt (the "Hustler" guy) and Francis (the "Girls Gone Wild" dude) are asking the government for a $5 billion bailout, claiming the adult entertainment industry has taken a huge shot to the face because of the downturn -- citing the fact that XXX DVD sales are down 22% from a year ago.
"With all this economic misery and people losing all that money, sex is the farthest thing from their mind," Flynt says. "It's time for Congress to rejuvenate the sexual appetite of America."
Francis sees his industry like the big three automakers, only BIGGER: "Congress seems willing to help shore up our nation's most important businesses; we feel we deserve the same consideration."
Francis says he's going to D.C. to personally make the pitch. Sounds like someone has a bone to pick.

Law enforcement sources say comedian/actor Faizon Love is the suspect in a battery last night in West Hollywood.
The incident went down at 1:00 AM this morning at the Standard Hotel. Love -- who played Big Worm in "Friday" -- allegedly struck a man in the head with his fist. By the time cops arrived, Love was nowhere to be found. Cops tell us -- they'd Love to talk to him.
In June 2007, Love was sued for allegedly committing a "barbaric assault" on a woman who was a former stage manager in one of his productions. She says the actor chased her around the table, yelled and cursed and threw chairs at her after she allegedly rejected his sexual advances. It appears a default judgment was entered against Love.

Kevin Federline's new chick isn't low rent -- she's no rent -- if you believe the landlord suing her for skipping out on her payments!
Sources tell TMZ Victoria Prince was booted from her Beverly Hills home back in September after she allegedly didn't pay rent for six months. We're told she struck a deal with her landlord to pay him back in installments, but she never made any of the payments.
Now, the landlord is suing Prince for $7500, but there's a catch -- nobody knows where to find her!
We're told her landlord tried to serve her where she works, but security wouldn't let the process server in. Try Vegas next?
Calls to Prince were not returned.

TMZ has obtained video showing the arrest of Josh Brolin and Jeffrey Wright last July, and it looks like the cops had their sights set on an ass-whuppin'.

It all went down in Shreveport, LA in July. Both actors were arrested for allegedly interfering with an officer. The tape we obtained begins with a passive Brolin -- his arm around fellow-actor Jeffrey Wright -- when a cop pepper sprays him in the face. But it gets more brutal -- when Wright is laying on the ground and it appears a cop repeatedly tasers him.
Today Blair Berk, the lawyer for Brolin and Wright, convinced prosecutors to dismiss all charges against all seven defendants in March, provided they obey the law until then.

Josh Brolin and Jeffrey Wright have just settled their criminal case in Shreveport, LA.

Brolin and Wright were charged with interfering with a cop during a bar brawl last July. Both actors were pepper sprayed and Wright was tasered.
Under the terms of the deal, as long as they don't have run-ins with the law from now till March 11, all charges will be dropped.
Score another victory for attorney Blair Berk.
UPDATE: TMZ contacted Wright for comment , who told us: "These arrests should never have happened. Thankfully the prosecution was able to see that and dismiss all charges. Unfortunately, there are no winners here, but I remain hopeful that Shreveport officials will be encouraged to dig at the root causes of certain police incidents down there. An old-fashioned refusal of service led to our arrest that night, and there's no room for that in America in 2009."

So here it is ... the surveillance footage that cops believe shows Charles Barkley blowing through a stop sign -- and picking up the mystery woman he allegedly claimed had a very special oral skill-set.

The tape -- which also shows a cop car from the DUI task force pursuing Barkley -- was shot from a nearby building in Scottsdale, Arizona on December 31. You first see a woman walking down the street. A short time later, you see Barkley's SUV blow a stop sign, and head in her direction. It appears the SUV stops up the street and picks her up.
Then a cop car comes into frame and chases after the SUV, stopping it for good.
The time code embedded in the footage is one hour off from the time marked in the police report, but we've learned the camera was programmed for Pacific standard time -- not Arizona time -- which is an hour ahead. We're told the camera could only program Pacific, Central and Eastern time.
Barkley is set to face a judge for his DUI arrest on January 20th ... As for the chick, we're thinkin' Sir Charles simply blew that one -- how's that for irony?

People in the bathroom trying to revive Jett Travolta believe they detected a "faint pulse" during the rescue effort.
We've now learned specifics about the circumstances surrounding Jett's death. The bathroom where John Travolta's son was found has a small toilet area with a door. Jett was found in that area with the door closed.
Jett had suffered a seizure and struck either the toilet or the wall as he collapsed. He was "bleeding in several areas," including his mouth. He had no cuts but did have bruises on his body. Jett had also been bleeding internally.
A funeral home official said the body was in "great shape" and showed "no sign of head trauma." In fact, we're told there was a considerable amount of blood after the resuscitation efforts but it could have been wiped clean after he died, and the color of Jett's skin could have masked bruises, since Jett had been dead for three days before the autopsy was performed.

The demure 30-year-old probation violator fulfilled her court-ordered community service by picking up the debris on the side of an L.A. freeway on Monday.
It's still unclear if her career was in one of those orange bags.

Ed McMahon and his wife Pamela sicked a vicious attack poodle on a process server -- allegedly. Here's how it all went down...
The Date: Saturday, January 3.
Time: 2:00 PM
Location: The McMahon estate ... (until they're kicked out)
The Poop: A process server was there to serve McMahon's legal papers. We're told the process server went up to the door -- Pamela answered -- and when he attempted to serve her, the server claims Pam released the poodle on him and it attacked him. The L.A. County Dept. of Animal Control confirmed the process server did have a dog bite on his right knee.
Status: Active Animal Control investigation.
Fun Fact: The process server is not a total wuss ... it was a standard poodle, not the "toy" variety.
Statement from Ed's rep, Howard Bragman: "Dog bites man is not news. Call me back when it's man bites dog."

Former NBA and "Best Damn Sports" star John Salley should have learned by now ... you don't tug on Superman's cape, and you don't mess around with the most feared legal pit bull in Hollywood.
Marty Singer -- who has struck the fear of God in people who messed with celebs like Arnold Schwarzenegger, Bruce Willis, Jim Carrey, Celine Dion and on and on -- is suing Salley for stiffing him on a serious legal bill.
Singer's firm, Lavely & Singer, was hired to have Salley's back after dude was sued back in 2005 allegedly for physically and mentally abusing his supposed mistress.
Singer's firm claims Salley has ignored repeated requests to pay the $50,599.22 bill, so it's game on in L.A. County Superior Court.
By the way, the case brought by the alleged mistress eventually was dismissed. No word if there was a settlement.

Rip Torn -- who gave us this absolute classic mugshot (left) a couple years back -- got pinched for yet another alleged DUI.
Cops say 77-year-old Rip was driving down Route 44 in Connecticut in his Subaru with an Xmas tree on top -- only problem was, he was in the breakdown lane, so they pulled him over. Popo says he failed part of a field sobriety test and refused to take a Breathalyzer test.
Torn pleaded not guilty yesterday in court to illegal operation of a motor vehicle while under the influence and failure to drive in the proper lane.
This is his third DUI in the last five years.
